Mine isn't doing very well i have it in the ground but it's not very big does anyone think I should transfer it to a pot any suggestions please

The soil should ideally be acidic and moisture retentative. If this is not the case try planting in large pot with ericaceous compost. Also these acers are originally woodland type plants, so a bit of dapple shade and a sheltered position may help @mazzabazza
